Soldier released while appeal is heard

A young Nova Scotia soldier who fatally shot a close friend in Afghanistan has been let out of prison while he appeals his case.

Matthew Wilcox is now living with his parents in Glace Bay.

He was sentenced to four years and dismissed from the military after he was found guilty of criminal negligence causing the death of  Cpl. Kevin Megeny in 2007.

Lawyers for Wilcox are appealing both his conviction and sentence, arguing the makeup of the jury was unfair and that jury members should have been permitted to view the scene of the shooting in Kandahar.
