Court dismisses appeal of Halifax man convicted in infant’s death

HALIFAX – Nova Scotia’s highest court has dismissed an appeal from a man convicted in 2012 of injuring and causing the death of his infant daughter.

Ashiqur Rahman was sentenced to 6 1/2 years in prison for aggravated assault and manslaughter.

The trial judge found Rahman lacked the empathy to understand he was injuring his seven-week-old child when he slapped and shook her in June and July of 2009.

Rahman’s lawyers argued the verdicts were unreasonable or resulted from the judge’s misapprehension of the evidence.

They also argued that the trial judge should not have relied on testimony from the mother of the deceased child, arguing she wasn’t a credible witness.

The Nova Scotia Court of Appeal issued a decision today that concludes the trial judge’s findings were supported by the evidence and that the mother’s testimony was properly assessed in the context of all the evidence presented.
