Nova Scotia Supreme Court Judge Michael Wood has found 50-year-old Barry Sinclair guilty of one count of break and enter.

Prosecutor Denise Smith explains the incident happened in the south end of Halifax on September 15th, last year.

“That case was one that was supported by the finding of his cell phone, within that residence on that date,” says Smith.

Sinclair was found not guilty for another break and enter charge, and was also acquitted of five voyeurism charges.

The crown says the voyeurism charges rested on the finding of a videotape containing the voyeuristic images, inside a dresser drawer in Sinclair’s apartment.

However, the court was not satisfied because no video camera was found inside the apartment, that it could be said affirmatively that Sinclair is the person that filmed the image.

Sinclair is scheduled to be sentenced on February 25th at 9:30am.
